No, he isn't, he easily could be a scum. But if he's a scum he deliberately choses another way of playing. He is horrible at this game, useless and no one can like him. Pretty bold if doing on purpose.

in theory we could easily kill him off

we did it plenty times this year (or at least, few time) last year
